DIRECT BOOK RENTAL CONTRACT FOR 22 DOGWOOD LANE, BIG CANOE, GEORGIA

 

1. Check-in time is 4 P.M. EST and check-out time is 10 A.M. EST. No early check-ins or late check-outs unless agreed upon with owners. There will be no refund or compensation given if renter checks out early, or for weather conditions, power outages, failure of appliances or other conditions beyond the reasonable control of owner.


2. Pets are NOT permitted. ($500 fine). Smoking is not permitted on Property ($300 fine).


3. We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.


4. We request payment be made through our Stripe online secure payments. Full amount to be made at time of booking. The rental contract does not need to be printed out and signed. By submitting payment, you have automatically agreed to the terms therein.


5. A 30 day notice prior to check-in date is required for cancellation. A full refund minus a $150 cancellation fee will be paid if cancelled within this time frame.


6. $300 Security Deposit will be charged 2 days prior to arrival and returned 7 days after departure.


7. The Good Neighbor Posting (attached) must be read and followed closely.


8. Linens and bath towels are included in the house; daily maid service is not included. A washer and dryer are in the house for your convenience along with laundry detergent and fabric softener.


9. Parking is limited to 5-7 vehicles. Vehicles are to be parked in driveway and garage only. Parking on the road is not permitted. Any illegally parked vehicle is subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. Vehicles can be parked in the Chapel parking lot; talk to owner for details.


10. The house is on a septic system which is very effective; however, do not flush anything other than toilet paper. No feminine products should be flushed. If it is found that feminine products have been flushed and clogs the septic system, you could be charged damages of up to two hundred dollars.


11. Inclement Weather: While not often, occasionally inclement weather will affect the North Ga. Mountains. We do not provide refunds for inclement weather and recommend our guests take advantage of private travel insurance option if concerned. Mountain roads can be winding and steeper than normal. While our roads are well maintained, and our cabin is easily accessible in any automobile, mountain roads should be driven with the utmost care.

 

12. All watercraft must be registered at the Marina. A fishing license is required & can be purchased at the Marina. Lake Petite is the fishing, boating lake; swimming is allowed in designated areas. There is swimming in Lake Disharoon as well as non-motorized water craft.


13. Renters enter any and all water at their own risk including inflatable swimming pool on deck, creeks, lakes, swimming pool, tubs and showers. All persons entering any water must wear life jacket and be able to swim; children under 18 must have adult supervision (who can swim). Owners will not be held liable for an injury or death due to any water related accident or any other incident while renting from owner.


14. Alcoholic beverages under the legal age of 21 are not allowed. Should a member of renter’s group, guest or invitee be arrested for underage drinking, owner may terminate the rental period and the total rental amount shall be forfeited. Illegal drug use is strictly prohibited. Kegs are not allowed on the premises.


15. No discharge of firearms, fireworks, explosives or other incendiary/explosive items is allowed on premises.


16. Fire pits and any outdoor burning except propane and charcoal grills are prohibited in Big Canoe. Do not build any other fire of any kind anywhere on premises except in indoor fireplaces. Arrest, eviction and/or stiff fines may occur if rules are not followed. Owner will not be held liable.


17. Renters will be liable for any fire or fire damage, inside or outside owner’s premises, any injury or death due to fire or smoke inhalation, and any damage done due to fire or smoke. Smoke detectors and fire extinguishers are placed strategically throughout the house.


18. Eviction: A material violation of the terms of this agreement by renter, or anyone for whom renter is responsible, which, in owner’s sole determination, results in damage to the premises, personal injury, a breach of the peace, a nuisance to others or a violation of criminal law or local code shall be grounds for the termination of renter’s tenancy, the immediate eviction of renter’s group and forfeiture of the total rental amount and the security deposit. Any fines assessed by Big Canoe POA due to rules broken by renters will be charged to the renter.


19.This agreement shall be governed by and construed in accordance with the laws of Georgia. Any dispute or action related to this agreement shall be instituted and prosecuted only in Pickens County, Georgia. Renters expressly consent to personal jurisdiction in such county and to extraterritorial service or process.


20. Waiver and indemnification: The undersigned hereby agree to indemnify and hold harmless owner against any and all claims, damages, losses, liabilities, costs or expenses, of whatever kind, which Owner may incur and which arise from or are related to Renter(s) or any member of the renter’s group or to renter’s guests or invitees’ use and occupancy of the premises or the premises equipment (including, without limitation, as a result or in connection with use of Owner’s canoe, water equipment, furniture or improvements, including, but not limited to, claims or liability for personal injury, death or property damage. The undersigned further agree that Owner shall not be liable to renter(s) or any member of the renter’s group, guests or invitees for any personal injuries (including, without limitation, death) or any damages to or loss of goods or property, regardless of who such injuries, damages or losses were caused or sustained, and whether or not the same were reasonably foreseeable. Renter Agrees to all people with his party, all guests and invitees read this entire agreement. Undersigned renter warrants that he has received, read & understood document.

GOOD NEIGHBOR POLICY - Noise levels must be kept to a minimum after 7 PM. – Exterior lighting must not become a nuisance to the neighboring properties. Please ensure all exterior lighting is turned off when not in use. - Outdoor burning is prohibited anywhere on the premises. - Parking on the street is not permitted. - Non-motorized vehicles are prohibited on many BC roads. List of roads is available at guard gate. - RV's, trailers, motorcycles and golf-carts (except on golf-course) are not permitted inside of Big Canoe. There is a gated and locked RV storage just outside the North Gate if you so choose. - Intentional feeding of the wildlife is prohibited. - Walking on the golf course is prohibited unless playing golf. - No unregistered water crafts are allowed on any BC lake. - Signs, balloons, etc. are not allowed leading to any residence. - Swimming is not allowed on Lake Sconti. Some, but not all portions of Lake Disharoon and Lake Petit are available for swimming when open.

 

House Rules:

Max 12 guests

No Smoking on Property. ($300 fine if broken).

No pets ($500 fine if broken).

No garbage to be left outside because of Bears.

Do not leave any food in car due to Bears.

Keep noise outside to a minimum at night.

Garbage must be taken to dump in Big Canoe upon leaving (12 min drive) due to Bear activity and no outdoor trash receptacles.
